Welcome to WafaSoft. These Master Terms & Conditions ("Terms") govern your access to and use of all mobile applications (Android and iOS), websites (including wafasite.com), digital services, and future software published, owned, or operated by WafaSoft ("we", "our", or "us").

By downloading, installing, accessing, or using any WafaSoft application, website, or service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use our services.

1. Scope of Application

These Terms apply universally to:

  • All Android applications published by WafaSoft.

  • All iOS applications published by WafaSoft.

  • All websites operated by WafaSoft (including wafasite.com).

  • All future applications, features, and digital services published under the WafaSoft brand, unless a separate, explicit set of terms is provided for a specific product.

2. License to Use

WafaSoft grants you a limited, non-exclusive, non-transferable, revocable license to use its applications and websites solely for personal, educational, informational, religious, or lawful commercial purposes in accordance with these Terms. You agree not to reverse engineer, decompile, modify, or distribute our software without explicit written permission.

3. Eligibility & Compliance with Platform Guidelines

  • Age Requirements: You must comply with the age restrictions set by applicable laws and platform policies (such as Google Play and Apple App Store guidelines). If you are under the age of 18, you may use our services only with the supervision and consent of a parent or legal guardian.

  • Platform Policies: By using our apps, you agree to comply with all applicable Google Play Developer Policies and Apple App Store Review Guidelines.

4. User Accounts & Registration

  • Account Creation: Certain features or apps may require you to create an account (e.g., via Firebase Authentication). You are responsible for maintaining the confidentiality of your account credentials.

  • Account Security: You agree to notify us immediately of any unauthorized use of your account. WafaSoft is not liable for any loss or damage arising from your failure to protect your account information. You are solely responsible for keeping your device and login information secure.

5. Purchases, Donations & Subscriptions

  • Purchases & Donations: WafaSoft may offer in-app purchases, digital goods, or accept voluntary donations to support development. All transactions processed via third-party app stores or payment gateways are final and non-refundable, except as required by applicable law.

  • Subscriptions: If premium subscriptions are introduced, subscription fees will be billed in advance on a recurring basis (monthly, annually, etc.). You may manage or cancel subscriptions through your respective app store account settings (Google Play or Apple App Store).

6. Availability & Beta Features

  • Availability: We strive to ensure continuous uptime, but services may occasionally be unavailable due to routine maintenance, server upgrades, internet outages, or force majeure events. We are not liable for any downtime or data loss.

  • Beta Features: We may release experimental, preview, or "Beta" features. These features are provided "as-is," may contain bugs, and can be modified or discontinued at any time without notice.

7. Acceptable Use Policy

You agree not to use our applications, websites, or services to:

  • Violate any local, national, or international laws, rules, or regulations (including GDPR, CCPA/CPRA, and the Indian DPDP Act).

  • Infringe upon or violate our intellectual property rights or the rights of any third party.

  • Upload, transmit, or distribute harmful code, malware, viruses, or destructive software.

  • Engage in fraudulent activities, phishing, or unauthorized data scraping.

  • Interfere with, disrupt, or burden the infrastructure or security of our servers, applications, or websites.

  • Harass, threaten, or harm other users or individuals.

8. Intellectual Property & Copyright (DMCA)

  • Ownership: All software, design, text, graphics, logos, icons, audio, video, and code comprising WafaSoft applications and websites are the exclusive property of WafaSoft and are protected by international copyright and intellectual property laws.

  • DMCA Notice: If you believe that any content hosted on our websites or applications infringes your copyright, please contact us with a detailed takedown notice containing proof of ownership.

9. Third-Party Trademarks

Google, Android, Google Play, Apple, iPhone, iPad, App Store, Firebase, AdMob, and AppLovin are trademarks of their respective owners. Their use does not imply endorsement by or affiliation with WafaSoft unless expressly stated.

10. User Generated Content (UGC) & Feedback

  • User Generated Content: If our services allow you to submit, upload, or post content (such as text, comments, or feedback), you retain ownership of your content, but you grant WafaSoft a worldwide, non-exclusive, royalty-free license to use, display, and distribute it solely for operating and improving our services. Prohibited content includes illegal, defamatory, or abusive material.

  • Feedback: Any feedback, ideas, bug reports, suggestions, or recommendations submitted to WafaSoft may be used freely without restriction, obligation, or compensation to you.

11. Third-Party SDKs, Services & Advertising Disclaimers

  • Third-Party SDKs: Our products integrate trusted third-party software development kits (SDKs) including Google Play Services, Firebase, Apple Services, and Android System Services.

  • Advertising Disclaimer: Some apps display advertisements via networks such as Google AdMob, Google Ad Manager, and AppLovin MAX mediation. WafaSoft does not control third-party ad content, and we are not responsible for the products, services, or privacy practices advertised by third-party networks.

  • External Links: Our services may contain links to external websites. We assume no responsibility for the content or practices of any third-party websites.

12. Artificial Intelligence (AI) Services & Disclaimer

  • Some WafaSoft applications feature AI-driven tools (content generation, translation, recommendations).

  • AI Disclaimer: AI-generated outputs are for informational/utility purposes only and may contain inaccuracies or errors. AI is not a substitute for professional legal, medical, financial, or religious advice/fatwa. Users must independently verify all AI outputs before relying on them. Avoid submitting highly sensitive personal or proprietary information into AI tools.

13. Islamic Content Disclaimer

  • Much of WafaSoft’s content relates to Islamic literature, history, and education.

  • Disclaimer: Islamic content, articles, and texts are provided strictly for educational, informational, and spiritual enrichment purposes. WafaSoft is not an issuing body for formal religious edicts (Fatawa). Users should consult qualified, authentic Islamic scholars where precise religious rulings or interpretations are required.

14. Privacy, Data Processing & Security

Your privacy is critically important to us. Our data collection, processing, retention, and deletion practices are governed by our Privacy Policy, complying with major privacy frameworks including GDPR, CCPA/CPRA, and the Indian DPDP Act. Users may request data deletion or exercise privacy rights by contacting us.

15. Export Control & Sanctions Clause

You agree to comply with all local and international export control laws and regulations. You shall not access, download, or use our services if you are located in a country subject to comprehensive international trade sanctions or embargoes. Furthermore, access to our services may be restricted or blocked for any individual or entity subject to applicable trade or economic sanctions.

16. Electronic Communications

By using our services, creating an account, or contacting us, you consent to receive electronic communications from us (e.g., via emails, push notifications, or notices posted on our websites/apps). WafaSoft does not guarantee that our services will be uninterrupted, secure, or error-free.

18. Limitation of Liability & App Store Terms

  • Limitation of Liability: To the maximum extent permitted by applicable law, WafaSoft and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use or inability to use our applications, websites, or services.

  • App Store Terms (Apple & Google): You acknowledge that these Terms are concluded solely between you and WafaSoft, and not with Apple Inc. or Google LLC. Apple and Google are not responsible for the applications, maintenance, support, or any warranties relating to WafaSoft products.

19. Indemnification

You agree to indemnify, defend, and hold harmless WafaSoft, its developers, and partners from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of your violation of these Terms or your misuse of our services.

20. Suspension and Termination

We reserve the right to suspend, restrict, or terminate your access to any WafaSoft application, website, or service at any time, without notice, for any reason, including violation of these Terms or applicable platform policies.

21. Governing Law, Dispute Resolution & Translation Clause

  • Governing Law: These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.

  • Dispute Resolution: Any dispute arising out of or relating to these Terms shall be resolved amicably through good-faith negotiations, failing which it shall be subject to the exclusive jurisdiction of the courts located in Karnataka, India.

  • Translation Clause: If these Terms are translated into Urdu, Arabic, Hindi, or any other language, the English version shall prevail in the event of any ambiguity, conflict, or inconsistency.

22. General Legal Provisions

  • Severability: If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

  • Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and WafaSoft regarding the use of our services.

  • Waiver: No waiver of any term shall be deemed a further or continuing waiver of such term or any other term.

  • Assignment: WafaSoft may assign or transfer its rights and obligations under these Terms to any third party (such as in the event of a merger, acquisition, or restructuring) without notice. You may not assign your rights without our prior written consent.

  • Survival: Provisions regarding Intellectual Property, Disclaimer of Warranties, Limitation of Liability, Indemnification, and Governing Law shall survive the termination of these Terms.

By downloading or using the app, these terms will automatically apply to you – you should make sure therefore that you read them carefully before using the app. You’re not allowed to copy, or modify the app, any part of the app, or our trademarks in any way. You’re not allowed to attempt to extract the source code of the app, and you also shouldn’t try to translate the app into other languages, or make derivative versions. The app itself, and all the trade marks, copyright, database rights and other intellectual property rights related to it, still belong to WafaSoft.

WafaSoft is committed to ensuring that the app is as useful and efficient as possible. For that reason, we reserve the right to make changes to the app or to charge for its services, at any time and for any reason. We will never charge you for the app or its services without making it very clear to you exactly what you’re paying for.

The WafaSoft's App app stores and processes personal data that you have provided to us, in order to provide my Service. It’s your responsibility to keep your phone and access to the app secure. We therefore recommend that you do not jailbreak or root your phone, which is the process of removing software restrictions and limitations imposed by the official operating system of your device. It could make your phone vulnerable to malware/viruses/malicious programs, compromise your phone’s security features and it could mean that the WafaSoft's App app won’t work properly or at all.

The app does use third party services that declare their own Terms and Conditions.

You should be aware that there are certain things that WafaSoft will not take responsibility for. Certain functions of the app will require the app to have an active internet connection. The connection can be Wi-Fi, or provided by your mobile network provider, but WafaSoft cannot take responsibility for the app not working at full functionality if you don’t have access to Wi-Fi, and you don’t have any of your data allowance left.

If you’re using the app outside of an area with Wi-Fi, you should remember that your terms of the agreement with your mobile network provider will still apply. As a result, you may be charged by your mobile provider for the cost of data for the duration of the connection while accessing the app, or other third party charges. In using the app, you’re accepting responsibility for any such charges, including roaming data charges if you use the app outside of your home territory (i.e. region or country) without turning off data roaming. If you are not the bill payer for the device on which you’re using the app, please be aware that we assume that you have received permission from the bill payer for using the app.

Along the same lines, WafaSoft cannot always take responsibility for the way you use the app i.e. You need to make sure that your device stays charged – if it runs out of battery and you can’t turn it on to avail the Service, WafaSoft cannot accept responsibility.

With respect to WafaSoft’s responsibility for your use of the app, when you’re using the app, it’s important to bear in mind that although we endeavour to ensure that it is updated and correct at all times, we do rely on third parties to provide information to us so that we can make it available to you. WafaSoft accepts no liability for any loss, direct or indirect, you experience as a result of relying wholly on this functionality of the app.

At some point, we may wish to update the app. The app is currently available on Android – the requirements for system(and for any additional systems we decide to extend the availability of the app to) may change, and you’ll need to download the updates if you want to keep using the app. WafaSoft does not promise that it will always update the app so that it is relevant to you and/or works with the Android version that you have installed on your device. However, you promise to always accept updates to the application when offered to you, We may also wish to stop providing the app, and may terminate use of it at any time without giving notice of termination to you. Unless we tell you otherwise, upon any termination, (a) the rights and licenses granted to you in these terms will end; (b) you must stop using the app, and (if needed) delete it from your device.

Changes to This Terms and Conditions

I may update our Terms and Conditions from time to time. Thus, you are advised to review this page periodically for any changes. I will notify you of any changes by posting the new Terms and Conditions on this page.
